1. Was it ethical for the National Enquirer to try to avoid suit in California?
The ethical issue here is the inability of the petitioners to face the consequences of their reckless acts, which had adverse consequences for the accused. The petitioners rely on a technical argument, though rejected eventually by the courts, of the state court not having sufficient personal jurisdiction to try the suit against them, since the Enquirer-article had been written and edited in Florida.
