In the scenario where 17 year old Jeremy Atwater has purchased of a car with Smooth Sales Used Cars the contract between the two would not be accepted because a minor cannot enter into a expect for necessities. Smooth Sales Used Cars should have done the due diligence to verify instead of assume the age of Jeremy prior to accepting the down payment. Smooth’s Sales Used Cars showed lack of reasonable care by not verifying that the age of maturity was reached prior to the contract.
The first outcome of this scenario should be that Smooth Sales Used Cars should accept the return of the car as Jeremy requested and provide a complete refund to Jeremy.
